ABORTION REGULATION LAWS: WHAT’S THE INDIAN LEGISLATION

  • US Supreme Court overruled Roe v. Wade (1973) ruling against state restrictions on abortion.
  • 24 nations, where 90 million or 5% of women of reproductive age live, have abortion restrictions.
  • The Medical Termination of Pregnancy Act, 1971 established women’s access to abortions in India two years before the US Supreme Court decision.
  • The Medical Termination of Pregnancy Act, sometimes known as the MTP Act, was passed in 1971 primarily as a method of population control.
  • In India, if a woman becomes pregnant as a result of rape or incest, she is permitted to get an abortion. Major fetal malformations may also be a reason to end a pregnancy medically.
  • Inadequate or failure of contraception. If the mother’s physical or mental health would be gravely harmed by the pregnancy, a woman may also choose to have an abortion.
  • An abortion can also be obtained in the event of a miscarriage, i.e., if the baby is dead within.
  • In India, a woman who is not married can also get an abortion.
  • In India, if a woman wants to get a pill to end her pregnancy, whether she is a minor or not, she must have a prescription from a qualified medical professional.
  • The safe abortion window was significantly increased from 20 weeks to 24 weeks in 2021 thanks to the revisions made to the MTP Act.

  • On 2nd June Supreme Court said that education has become an industry fee prohibitive.
  • On 2nd June Supreme Court said that “9k per month is nothing but exploitation” regarding Odisha home guards’ salary.
  • On 3rd June 2022 Supreme Court held that Arya Samaj’s marriage certificate is invalid.
  • On 6th June 2022 Supreme Court objects to frivolous PIL petitions, ‘luxury litigations’ eating up court time.
  • On 9th June 2022, Supreme Court allows present Secretary of the All-India Chess Federation to continue till August 15th.
  • On 9th June 2022, Fresh pleas were filed in the Supreme Court against 1991 law on religious places.
  • On 9th June 2022, Supreme court reserves orders on pleas seeking special stray round of counselling for NEET-PG.
  • On 10th June 2022, Madras High Court gets its first woman mace bearer.
  • On 10th June 2022, Kerala High court held that teens having sex unaware of POSCO Act and suggests teens should be given awareness.
  • On 14th June 2022, over 400 Supreme Court’s verdict were translated until Covid-19 stalled AI project.

Know Your Judiciary

  • Former Chief Justice of India from 2007 to 2010.
  • Justice Balakrishnan was the first Judge from Kerala to become Chief Justice of Supreme Court.
  • Justice Balakrishnan has been the Chairperson of National Human Rights Commission.
  • He has authored a total of 219 judgements and been a part of 787 benches.
  • His most important judgement was relating to abortion in privacy judgment.
  • He has given judgements in many landmark cases like Mondal Commission case, Sanjay Dutt case and Bellary mining case.
  • He was the longest serving Chairperson of National Human Rights Commission.

We are the land of Kamasutra and the land of Devadasis, yet the law of land that has made bodily autonomy a matter of taboo and policing for decades. After so many years of shame, shunning and exploitation, it is a welcoming decision from the apex court of the country, guaranteeing the human rights, dignity and protection that should have been afforded to the dingy lanes of sex work in this country. The journey ahead will be long and perilous but it is the first step that is often the hardest to make and with decision, we have done just that.
